1. Acceptance of Terms

By accessing or using futurein.ai (the "Service", "Platform", or "Website") at https://futurein.ai, you ("User", "you", or "your") agree to be bound by these Terms and Conditions ("Terms"). These Terms constitute a legally binding agreement between you and futurein.ai Ltd. ("Company", "we", "us", or "our").

If you do not agree to all of these Terms, you may not access or use the Service. Your continued use of the Service constitutes ongoing acceptance of any updates to these Terms.

2. Description of Services

futurein.ai provides an AI-powered career assessment platform that enables users to:

• Upload resume documents (PDF, DOCX) or connect LinkedIn profiles for skill extraction and analysis
• Receive an AI-generated assessment of their current skills, experience, and transferable competencies
• Discover emerging AI-era job roles matched to their profile across global markets
• Access personalised learning roadmaps, skill gap analyses, and salary benchmark data
• Access curated educational content, articles, and career guidance resources

The Service is provided for informational and career planning purposes only. We do not guarantee employment outcomes, job placements, or specific salary results.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice to users.

3. User Accounts

3.1 Registration

To access certain features of the Service, you must create an account using a valid email address. You agree to provide accurate, current, and complete information and to update it as necessary.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at security@futurein.ai if you suspect unauthorised access to your account. We are not liable for any loss resulting from unauthorised use of your account.

3.3 Age Requirements

You must be at least 18 years of age to use the Service, or the age of majority in your jurisdiction if higher. By creating an account, you represent that you meet this age requirement.

3.4 Account Sharing

Except where expressly permitted under a team plan, accounts are for individual use only and may not be shared. We reserve the right to suspend accounts where we reasonably believe account sharing is occurring.

4. Subscriptions & Payments

4.1 Plans

We offer three service tiers: Explorer (free), Pathfinder (A$29/month or A$19/month billed annually as A$228/year), and Navigator (A$75/month or A$49/month billed annually as A$588/year). Prices are displayed in Australian Dollars (AUD). Stripe automatically converts to your local currency at checkout. Prices may be subject to applicable taxes depending on your location.

4.2 Billing

Paid subscriptions are billed in advance on a monthly or annual basis. Payment is processed by Stripe, Inc., our third-party payment processor. By providing payment information, you authorise us to charge your payment method for all fees incurred.

4.3 Free Trial

Paid plans may include a 7-day free trial. At the end of the trial, you will be automatically charged the applicable subscription fee unless you cancel before the trial expires. Only one free trial per user or payment method is permitted.

4.4 Price Changes

We may change subscription prices with at least 30 days' notice sent to your registered email address. Continued use of the Service after the price change takes effect constitutes your agreement to the new price.

4.5 Taxes

You are responsible for all applicable taxes associated with your use of the Service. Where required by law, we will collect and remit taxes on your behalf.

5. Refund Policy

futurein.ai does not offer refunds on paid subscriptions. All paid plans begin with a 7-day free trial during which your payment method is not charged. You may cancel at any time during the trial period at no cost. Once the trial period ends and your first payment is processed, that charge is non-refundable except where required by applicable consumer protection law in your jurisdiction.

Annual subscriptions are not refunded on a pro-rata basis for unused months, unless mandated by applicable law. We reserve the right to issue refunds at our sole discretion in exceptional circumstances.

Australian Consumer Law: Nothing in this refund policy limits any rights you may have under the Australian Consumer Law, including rights relating to services not fit for purpose or not provided with due care and skill.

EU/UK consumers: If you are a consumer located in the EU or UK, you may have a statutory right to cancel within 14 days of purchase (cooling-off period). However, by accessing paid features before this period expires, you expressly request early performance of the contract and acknowledge that your right of withdrawal may be forfeited once digital content delivery has commenced.

6. Data & Privacy

Your privacy is important to us. Our collection and use of personal information, including resume data and LinkedIn profile information, is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the Service, you grant us a limited, non-exclusive, non-transferable licence to process the data you upload solely for the purpose of providing the Service to you. We do not sell your personal data or resume content to third parties. We do not share your information with potential employers without your explicit consent.

Data minimisation: We recommend removing personal contact details (phone number, home address, national ID numbers, tax file numbers) from your resume before uploading. We automatically sanitise file names and strip personal identifiers before AI analysis. Raw resume files are never stored — only the structured career analysis output.

Retention: Resume analysis results are retained for 24 months. Chat messages are retained for 12 months. Activity logs are retained for 24 months. Security event logs are retained for 12 months. All data is automatically purged at the end of these periods.

Your rights: You may request a copy of your data, correction of inaccurate data, or permanent deletion of your account and all associated data at any time by contacting privacy@futurein.ai or using the data rights tools in your account dashboard. We respond within 30 days.

7. Intellectual Property

All content on the Service, including but not limited to the AI assessment algorithms, job match methodology, text, graphics, logos, and software, is the exclusive property of futurein.ai Ltd. and is protected by applicable intellectual property laws.

You retain ownership of any content you upload (e.g., your resume). You grant us a limited licence to process that content as described in Section 6.

You may not reproduce, distribute, modify, or create derivative works from any part of the Service without our express written permission.

8. Prohibited Uses

You agree not to use the Service to:

• Upload false, misleading, or fraudulent resume or profile information
• Scrape, crawl, or automatically extract data from the platform
• Attempt to reverse-engineer, decompile, or access the source code of our AI systems
• Create multiple accounts to circumvent usage limits or free trial restrictions
• Use the Service for any unlawful purpose or in violation of any applicable law
• Transmit viruses, malware, or any other harmful code
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Use the Service in any manner that could disable, overburden, or impair the platform

9. Disclaimers & Limitation of Liability

9.1 "As Is" Service

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

9.2 Career Outcomes

futurein.ai provides career information and assessments for informational purposes only. We do not guarantee specific employment outcomes, salary levels, or career results. Job market conditions change rapidly and individual results will vary.

9.3 Limitation of Liability

To the fullest extent permitted by law, futurein.ai Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any direct damages shall not exceed the amount paid by you to futurein.ai in the 12 months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these Terms, with or without prior notice. Upon termination, your right to use the Service ceases immediately.

You may cancel your subscription at any time through the Billing Portal or by contacting support@futurein.ai. Cancellation takes effect at the end of the current billing period — you retain full access until then. Downgrade to the free Explorer plan occurs automatically.

13. AI-Generated Content (EU AI Act)

futurein.ai uses artificial intelligence systems to generate career assessments, job match scores, skill gap analyses, and learning roadmaps. These outputs are AI-generated and are provided for informational and career planning purposes only. They do not constitute professional career advice, employment guarantees, or guaranteed salary outcomes. You should use AI-generated assessments as one input among many in your career decision-making.

In compliance with the EU Artificial Intelligence Act and applicable transparency requirements, we disclose that our core assessment functionality uses a large language model (Claude by Anthropic). Our AI systems are not used for biometric identification, real-time surveillance, or any high-risk AI use cases as defined under the EU AI Act.

14. Automatic Renewal

Paid subscriptions automatically renew at the end of each billing period (monthly or annual) until cancelled. You will be charged the then-current subscription fee to your payment method on file. We send a reminder email 24 hours before your trial ends and at least 7 days before any annual renewal. You may cancel at any time via the Billing Portal at billing.stripe.com.

For Australian users: this constitutes the required disclosure under the Australian Consumer Law regarding automatically renewing contracts.

15. Complaints Process

If you have a complaint about our service, please contact support@futurein.ai. We aim to respond within 5 business days. If your complaint is not resolved to your satisfaction, you may escalate to:

• Australia: Australian Competition and Consumer Commission (accc.gov.au) or your state consumer affairs office
• UK: Citizens Advice or the Financial Ombudsman Service (for billing disputes)
• EU: Your national consumer protection authority or the European Consumer Centre
• India: National Consumer Helpline (consumerhelpline.gov.in)

16. Affiliate Programme

Participation in the futurein.ai affiliate programme is subject to these additional terms: Commission is paid on net revenue after chargebacks and refunds. We reserve the right to terminate affiliate relationships for fraudulent referrals, self-referrals, or violation of our terms. Affiliates are responsible for complying with applicable tax obligations in their jurisdiction, including reporting affiliate income. futurein.ai does not provide tax advice. Commission payments are made monthly for balances above A$50.

11. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be subject to the non-exclusive jurisdiction of the courts of Victoria, Australia.

Nothing in these Terms limits any rights you may have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)), the UK Consumer Rights Act 2015, EU consumer protection legislation, or other applicable mandatory consumer protection laws in your jurisdiction. If you are a consumer under applicable law, you retain all statutory rights regardless of these Terms.

For users in India, we comply with the Digital Personal Data Protection Act 2023 (DPDP Act). For users in the United States, we comply with applicable state privacy laws including the California Consumer Privacy Act (CCPA). For users in Brazil, we comply with the Lei Geral de Proteção de Dados (LGPD).
